Public Charitable Trust

 

Registrtion under Trust Act:  Many not for profit orgnisations prefers to register under Societies Registration Act or under Trust Act.   Under this Act organizations can register as a public Trust, Private Trust.    Not for profit organsiations comes under Public Charitable Trust and  for PCT the Trust Act of 1982 may not be applicable and this Trust can be formed under General Law.    Organisations can also register under Bombay Trust Act, 1950, Religious Endowment Act, 1863 and Charitable &Religious Trust Act of 1920.  A Trust can be formed by any individual or group of individuals, Institution etc.


To form a Public Charitable Trust  the organisation’s aims and objectives must be charitable in nature.  (providing financial support to poor, relief activities etc.)


How to start a Public CharitableTrust:.


      ▪ Prepare a Trust Deed this deed should clearly mention its objectives,

        details of the Trustees.

    

     ▪ The need to be registered with the sub-registrar of registration of

       state govts.


To run a Trust one needs to ensure that all the objectives mentioned in the deed should be adhered to e.g. Conducting regular meetings and preparation of minutes, allocation of functional responsibilities, Bank accounts and signing authority, meeting statutory requirements such as auditing, income tax related etc.
