FCRA(Foreign Contributions Regulations Act) In India not for profit organizations, who have registered their organization under Societies’ Registration Act/Trust or as not-for-profit companies, who wishes to receive donations from foreign sources need to have the Foreign Contributions Regulation registration.   The process for applying for this registration is given below:   • The organization  should have been registered  as a Trust or a Society or    as a not for profit companies.                    • In general most of the NGOs will have opened their organizational                        account for various purposes of the organization which is called a                       ‘General Account.  Using this account an organization can receive                        funds from within the country.  However, to receive foreign                        donations, they need to open a separate bank account which is                        generally called as a F.C.Account of an organization.  While applying                         for F,C, Registration, the organization need to give the F.C.Account                        details to the Ministry of Home Affairs.                     • The organization concerned need to apply for registration using Form –                    FC-8.                    • Organisations ‘ Activity Report for the past three years •  Audited Statement of Account for the past three years (Balance    Sheet,   Income and  Expenditure, Receipts and Payments Account    alongwith   audit    report).                    • Details of the areas of operation of the organization.                    • Background paper of the area and the beneficiaries to be covered  In addition to the above if your organization is a  Society: the following need to be attached.                    •  Certified copy of Registration Certificate by the Registrar of                         Societies or by Charity Commission in case of Maharastra or Gujarat                          You also need to attach a copy of the organisations’ bye-laws. Trust, then also attach:                    • Certified copy of Registered Trust Deed                    • Certified copy of Registration Certificate issued by Charity                                      Commissioner (inclusive of Gujarat and Maharastra).  a non-profit company, then also attach                    •  Certified copy of  Memorandum and Articles of Association                   •  Certified copy of the registration certificate issued by the Registrar    of   Companies                             •  Certified copy of section 25 licence issued by Regional Director,     Deptt. of  Company Affairs.
